Terms and Conditions

Welcome to Early Greens website.
  • This Website and its related services are owned and operated by Ben Meekee Limited ("we", "us", or "our").
  • By accessing our Website, purchasing our products, or signing up for a subscription, you ("Client", "Reseller", "you", or "your") agree to be legally bound by the following Terms and Conditions.

1. Nature of the Product
1.1. Living Crops
  • All microgreens sold through this Website are delivered as live, growing plants cultivated on a non-toxic, edible bamboo paper grow bed. We do not cut or supply ready-to-eat microgreens products.

1.2. No Growing Media
  • We do not use soil, cocoa coir, or fibrous/synthetic media.

1.3. Perishable Goods
  • Because our products are live agricultural goods, they require immediate care upon delivery as outlined in Section 8.
2. The 3-Week Custom Cultivation Cycle

2.1. Custom-Grown to Order
  • We do not hold ready-to-ship inventory. Every tray purchased is custom-seeded and grown specifically for your order.

2.2. Lead Time
  • All initial individual purchases, new subscriptions, and increases in order volume require a strict 3-week (21-day) advance cultivation period before the first delivery can be fulfilled.
4. Wholesale Packs
4.1. Our products are structured into four distinct wholesale tiers:
  • Sample Pack
    Live tray(s) with guaranteed total yield of 1 kg.
  • Trial Pack
    Live tray(s) with guaranteed total yield of 3 kg.
  • Starter Pack
    Live tray(s) with guaranteed total yield of 6 kg
  • Business Pack
    Live tray(s) with guaranteed total yield of 12 kg.
  • Growth Pack
    Live tray(s) with guaranteed total yield of 24 kg.
5. Payment Terms & Billing
51. Upfront Payment
  • For One-off orders, full payment is required to reserve your space on our growing racks and initiate the 3-week cultivation cycle.
5.2. Subscription Orders:
  • All subscription orders require an upfront deposit payment of 25% of their price, with the remainder spread over the length of your subscription as weekly payments.
  • Subscriptions are processed via recurring automatic billing on the Monday of each week.
  • Your weekly payment locks in the seeding and cultivation of the crop to be delivered exactly three (3) weeks from that payment date.

5.3. Failed Payments
  • If a subscription payment fails, your custom crop will not be seeded for that cycle, and your delivery schedule will be paused or terminated until you restore your account to credit, but you will be billed for that week, because some costs have already been incurred for your whole order.
5. Cancellation, Modifications, & Refunds
5.1. The 21-Day Cut-Off
  • You may cancel or modify a one-off order for a full refund up to 21 days prior to your scheduled delivery date.

5.2. Late Cancellations
  • Cancellations or reductions in volume made within 21 days of the scheduled delivery date are strictly non-refundable, as your crops have already entered production.

5.3. Subscription Cancellation
  • To pause, reduce, or cancel a weekly standing order, you must provide a strict 3-week notice period. You will be automatically billed for and will receive, any crops that have already entered the 3-week cultivation cycle prior to your notice.

6. Deliveries & Logistics

6.1. Geographic Scope

  • We deliver exclusively to commercial venues within the London Boroughs of Camden, Haringey and Islington, and designated surrounding routes. We reserve the right to reject orders outside our delivery radius.

6.2. Delivery Days

  • Fulfillments are carried out strictly on Mondays and Thursdays. Your delivery day will be confirmed upon order placement.


6.3. Venue Access

  • The Client must ensure their venue is accessible to our delivery team during the agreed delivery window. If a delivery fails because your venue is closed or inaccessible, the driver will leave the trays at your threshold if safe to do so, or return them to the farm. No refunds or replacements will be issued for missed deliveries due to client inaccessibility.

7. Transfer of Risk, Inspection, & Claims
7.1. Acceptance of Goods
  • Risk of loss or damage transfers entirely to the Client the moment the living trays are dropped off at your venue.

7.2. Mandatory Inspection
  • You must visually inspect all living trays immediately upon delivery.

7.3. 4-Hour Reporting Window
  • Any claims regarding damaged trays, missing items, or quality issues must be reported to us via email or phone within four (4) hours of delivery.

7.4. Evidence Requirement
  • All claims must be accompanied by clear, time-stamped digital photographs of the specific issue.

7.5. Remedies
  • Verified and timely claims will be resolved at our sole discretion via an invoice credit note for your next order, a priority replacement on our next delivery day, or a partial refund.
8. Post-Delivery Care Exclusions
8.1. Early Greens guarantees that our microgreens leave our facility in peak health.
  • 8.2. We are not liable for any crop deterioration, wilting, mold, or plant death caused by improper handling or storage at your venue, including but not limited to:
    • Failure to bottom-water the bamboo beds daily.
    • Exposing trays to extreme temperatures, hot kitchen passes, or direct drafts.
    • Placing trays in harsh, direct storefront sunlight.
9. Food Safety & Reselling Compliance
9.1. Our microgreens are grown using non-GMO, organic heirloom seeds and clean, treated water with no artificial fertilizers.
9.2. Once delivery is accepted, the Reseller assumes all legal responsibility for maintaining food hygiene standards, safe handling, and proper temperature controls while storing, preparing, or selling the greens to end consumers.
10. Limitation of Liability
10.1. To the maximum extent permitted by UK law, Ben Meekee Limited (trading as Early Greens) shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, revenue, or customer goodwill, arising out of or in connection with our products or services.
10.2. Our total liability for any claim arising from a transaction shall not exceed the total amount paid by you for that specific order.
11. Governing Law
11.1. These Terms and Conditions shall be governed by, interpreted, and enforced in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

3.2. Early Greens reserves the right to adjust wholesale pricing at any time. Any price changes will be communicated to active subscription clients at least 30 days in advance.
3. Selected Crops
3.1. Our "Business MIcrogreens" products are based on eight (8) edible plant varieties - broccoli, pea shoots, radish, sunflower, mung beans, fenugreek, rocket, and red cabbage. Any changes to this selection will be communicated to active subscription clients at least 30 days in advance.
